Something Rotten In Denmark


In the Article 32 hearing (military speak for pre-trial hearing) and the subsequent announcement to refer Pendleton 8 member PFC John Jodka to court martial, the Investigating Officer at the Article 32 hearing noted the inherent problems with the case, including: the evidence, witness availability, and recommended the dismissal of several charges.

However, General Mattis used in his court martial convening order, the recommendations of his Staff Judge Advocate. This now brings into question the value of the Article 32 process.

Jodka's attorney's had originally requested to waive the Article 32 hearing and go directly to trial- as is their right - and begin the process of an early start in exonerating PFC Jodka.

The government however denied Jodka's right to request a waiver of the Article 32.

Update: Article 32 Hearing Postponed

The Article 32 hearing (military speak for pre-trial hearing) in the case of Pendleton 8 member Melson Bacos- originally scheduled for Wednesday September, 27th- has been postponed until October 19th.
Some believe this is a strategic move... designed to wait and see... the response to any motions the defense may make regarding the three Pendleton 8 cases that are already proceeding to Court Martial. Keep checking back for updates.

Demonstrations Spread In SoCal

Demonstrations of support for the Pendleton 8 are spreading in southern California.

For the second straight weekend a lively demonstration occurred in the upscale community of Huntington Beach, CA located in Orange County. In Oceanside, CA the number of demonstrators outside the gates of Camp Pendleton are growing in number, after having experienced an initial dip this summer.

The personal motivation of each person demonstrating varies. After interviewing several of the demonstrators I have found their motivation generally boils down to one of four reasons: 1) They are upset at the government's mistreatment of the Pendleton 8   2) They have a general mistrust of the military judicial system  3) They are infuriated over a perceived presumption of guilt portrayed in the media  4) They believe the 'The Pendleton 8' are innocent.

Originally, demonstrations began outside the gates of Camp Pendleton and went largely unnoticed to the outside world. That all changed when a housewife and mother (and demonstrator) named Christina phoned in to the nationally syndicated Michael Savage Show. Savage brought national attention to both the treatment of 'The 8' and their supporters.

Defense attorney Joseph Low has said, "They (Pendleton 8) cannot see the demonstrators...They cannot hear the demonstrators...But they can feel their energy".

Demonstrations have also raised money to aid families of 'The Pendleton 8' with their legal defense fees.

Are they Heros or Murderers?
Daily our soldier are confronted with a situation in which you cannot tell who is good and who is bad. When he mistakenly identifies a bad guy as a good guy and is killed we call him a Hero. If he mistakenly identifies a good guy as a bad guy and kills him he is now a murderer who will no be put on trial for murder.

At no time in the history of warfare has so much been asked from a soldier. These men and women are laying down their lives for freedom, yet are not allowed to make a mistake or it will cost them theirs.

Why our our leaders not defending them? I believe they more concerned with looking good than doing good.

Changes In Latitude, Changes In Attitude

The news of President Bush and Senate Republicans reaching a tentaive agreement to allow for tough interrogation tactics of detainees, brings to mind comments made by a recent guest of my radio show.

Attorney Joseph Low represents Cpl. Marshall Magincalda. Cpl Magincalda, 23, has served three terms in Iraq and is one of the imprisoned Pendleton 8. Low had this to say recently:

"What it interesting is that at a time when the Commander In Chief is asking for more latitude in dealing with suspected terrorists, no latitude is afforded the Pendleton 8. The one person who they (military) ultimately serve is the Commander In Chief. He is one the person who can step in (Pendleton 8 case) and make a difference. Yet he has done nothing while at the same time asking for more latitude".

The Pendleton 8   are 7 Marines and a Naval Corpsman being held in a Camp Pendleton  brig for allegedly kidnapping and murdering an alleged Iraqi civilian.

Because They Hate

The visit by Iranian President Ahmadinejad to the UN reminds me of two insightful books written by recent guests of my radio show.

The first is written by Tony Blankley and is titled, THE WEST'S LAST CHANCE, Will We Win the Clash of Civilizations? Blankley of course is the editorial editor of the Washington Times and former Reagan speech writer. His book takes a hard-hitting look at the danger posed by radical Islam and what must be done to counter it NOW. He compares the threat of radical Islam to that of Nazi Germany.

The other timely book I highly recommend is written by Brigitte Gabriel and is titled BECAUSE THEY HATE: A Survivor of Islamic Terror Warns America .  Gabriel, a Lebanese born American, warns of the dangers of 'political correctness' in the war against terrorism.

Military Lawyers: All Time High



There is an excellant article by written Bill Gertz and Rowan Scarborough in the September 15th edition of The Washington Times.

The article points out that the number of military lawyers is now at an all time high, 10% larger than it was after the cold war.

The article explains a disturbing trend inherint to almost all beuaracracies: justification for job promotion. The three senior JAGs for the Army, Navy and Air Force, known as TJAGs, want three-star rank similar to the surgeons general of the services. But they need a larger corps of military lawyers to justify the boost in rank, it has been reported. Legislation to increase the three-star rank was proposed this year but failed from lack of Pentagon support.

Pendleton 8 Item: This Case Is Not 'That Case'

There is a lot of confusion among the general public- and in the media as well- between the Pendleton 8 case and other cases. This is completely understandable given the busy lives we live these days and the amount of information overload we get bombarded with daily. 

Most people I meet mistake the Pendleton 8 case with  a diffferant case which involves allegatons of rape in Mahmoudiya, Iraq. The Pendleton 8 is not that case.

Another case which people are unclear about is a case often referred to simply as Haditha, in the media. The Haditha case, involves allegations of massacre of innocent Iraqi civilians, and also is not the Pendleton 8 case.

Let me be very clear: The Pendleton 8 case is not the case which involves allegations of rape, or allegations of massacre  They are three completely different cases.

The Pendleton 8 case involves the alleged pre-meditated kidnapping and murder of an alleged Iraqi civilian by 7 Marines and a Navy Corpsman.

Pendleton 8 Item: Solitary Confinement


According to the government the Pendleton 8 are being held in "Special Quarters" not in  solitary confinement, and in fact objects to use of the phrase solitary confinment when describing the Pendleton 8.

So just what is "Special Quarters" and what does it mean?

It means that the Pendleton 8 spend 22 hours out of every 24 hours alone, solo, locked in an 8x9 box...and have done so for the past 120 days.

The government defines solitary confinement as 24 out of 24 hours.

We Told You So...


Saturday September 9th during my radio show I interviewed Tim Sullivan of The San Diego Union-Tribune. Sullivan is the highly acclaimed sports writer who is covering the story of the shooting of San Diego Charger linebacker Steve Foley by an off duty Coronado, CA police officer, in an unmarked car.

I reported on the air that a highly reliable source had informed me that Foley had a gunshot wound in the back of his leg, a story which had not yet been made public.

Four days after my on air announcement (Wednesday, 9-13-06),  photos of gunshots wounds to the back of Foley's leg were made public.

I said it before and I will say it again... when all is said and done the city of Coronado will be the big loser in this case...and that bridge will soon be a toll bridge, again.

The Rubber Hose Story, Clarified


This past Saturday during an interview on my radio show, attorney Jane Siegal (attorney for Pfc John Jodka of the Pendleton 8 ), clarified the story of the photo of the rubber hose.

I had previously written in a Washington Times article that the defense had entered into evidence, a photograph taken in a Camp Pendleton NCIS investigation room of a rubber hose on a whiteboard with the words "my psychological friend" written underneath. 

This past Saturday Jane Siegal clarified that the rubber hose photo was from a NCIS investigation room in Iraq, and not Camp Pendleton as originally reported.

Nonetheless the photo does exist, has been entered into evidence and is disturbing.
